Agreement of Use

The use of this Web Site ("Site") is provided by Robert K. Ace Jr. Construction LLC. ("RKA”,"we," "us") subject to your compliance with the terms and conditions that we set fourth in this agreement (the "Agreement"). By using the Site, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, please do not use the Site. This Agreement is made between RKA and Site visitor and/or member ("you"). We reserve the right at anytime to:

• Change the terms of this Agreement; or
• Change the Site, including termination and introduction of new features and content.
• Any changes we make will be effective immediately upon notice either through posting the change to the Site or via e-mail to each account. Your use of the Site after such notice will be deemed acceptance of such changes.

Code of Conduct

While using the Site, you agree to comply with all applicable laws, rules and regulations. You also agree not to:

• Use the site for any unlawful purpose;
• Express or imply that any statements you make are endorsed by us, without our prior written consent;
• Restrict or inhibit any other visitor or member from using the Site, including, without limitation by means of "hacking" or defacing any portion of the Site;

Transmit:

• Any content or information that is unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene or otherwise objectionable, or infringes on our or any third party's intellectual property or other rights;
• Modify, adapt, sub-license, translate, sell, reverse engineer, decompile or disassemble any portion of the Site;
• Remove any copyright, trademark, or other proprietary rights notices contained in the Site;
• "Frame” or “mirror” any part of the Site without our prior written authorization;
• Link to any page of or material on the Site other than the URL located at www.rkaconstruction.com;
• Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, “data mine,” or in any way reproduce or circumvent the navigational structure or presentation of the Site or its contents; or
• Harvest or collect information about Site visitors or members without their express consent.

Registration

Registration is required for full use of the Site. As part of this process you will be asked to select a password and are responsible for the confidentiality of your password. You are also responsible for the use of your user account, whether or not authorized by you. If you suspect any unauthorized use of your user account it is your responsibility to NOTIFY US immediately.

Disclaimers

The Site and the Materials on the Site are provided “AS IS” and without warranties of any kind, either express or implied. We disclaim all warranties, express or implied, including, but not limited to, implied warranties of title, non-infringement, merchantability, and fitness for a particular purpose. We will not be held responsible for any loss or damage, including personal injury or death, resulting from anyone’s use of the Site, the content on the Site and any interactions between users of the Site, whether online or offline. We assume no responsibility for any defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user communications. We are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to users’ or to any other person’s computer related to or resulting from using the Site. We are not responsible and do not warrant that the Site (or the server(s) on which it is hosted) is free of viruses or other harmful components. We can not guarantee that the Site will be totally error-free, uninterrupted, and secure, that defects will be corrected. You are responsible for all equipment in order to use our Site. Your use of the Site and any materials provided through the Site are entirely at your own risk.

Limitation of Liability

RKA shall not be responsible or liable for any indirect, incidental, consequential, special, exemplary, punitive or other damages under any contract, negligence, strict liability or other theory from the use of the Site or any information or content obtained from within the Site even if RKA has been notified about the possibility of such damages. The sole remedy for dissatisfaction with the site is to stop using the site. The sole exclusive maximum liability to RKA for all damages, losses, and causes of action (whether in contract, tort (including, without limitation, negligence), or otherwise) shall be the total amount paid by you, if any, to access and use the Site.

Disputes

If there are any disputes about or involving the Site, by using the Site, you agree that the dispute will be governed by the laws of the State of Pennsylvania without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the state and federal courts of the State of Pennsylvania.

Indemnification

You agree to defend, indemnify, and hold harmless us, our officers, directors, employees and agents, from and against claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Material or your breach of the terms of these Terms and Conditions.

Agency

There is no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship between RKA and any user.

Other

Use and Membership to the Site constitute acceptance of this Agreement. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
